JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 139 of 2019 disclosing offences under Sections 323, 504, 498A, 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Petitioners happens to be the father-in-law, mother-inlaw and married Nanad of the complainant. Case is of demand of motorcycle and for that, subjecting her to mental and physical torture and also trying to kill her.
Submission of the learned counsel for the petitioners
Patna High Court CR. MISC. No.82469 of 2019(2) dt.12-12-2019 2/2 is that they have falsely been implicated in this case. Petitioners no.3 and 4 are married nanad and they are residing separately. Moreover, they are still ready to keep her with dignity and care. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, surrender before the court below within a period of four weeks from the date of receipt of certified copy of this order, on surrender, they will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M., Sikrauna, at dhaka, East Champaran, in connection with Complaint Case No. 139 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that if there is any chance of settlement between the parties or the petitioners shall co-operate in settlement of the dispute.
