2. The petitioner seeks bail in connection with Jadia P.S. Case No. 32 of 2024 instituted for the offences under Section 302/34 of the Indian Penal Code.

3. The prosecution case is to the effect that the informant has stated that his cousin namely Pinki Devi was killed by the petitioner and other family members after she was beaten mercilessly.

It is submitted by learned counsel for the petitioner that the petitioner being husband has falsely been implicated in this case as an afterthought as the informant happens to be a cousin of the deceased despite the fact that there are four own brothers of the deceased. No.88629 of 2024(3) dt.07-05-2025 2/3 sel for the petitioner that the incident has occurred almost after ten years of marriage and during the course of investigation it has come through the statement of various witnesses that on the date of occurrence the deceased was scolded by the petitioner as well as his brother namely Sanjay Mandal and in a fit of anger she had consumed poison. It is also submitted by learned counsel for the petitioner that the brother of the petitioner namely Sanjay Mandal has been granted bail by a Co-ordinate Bench of this Court vide order dated 05.12.2024 passed in Cr. Misc. No. 57158 of 2024. It is lastly submitted by learned counsel for the petitioner that the petitioner has clean antecedent and is in custody since 17.04.2024.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions of respective counsels and taking into account the fact that there is nothing on record to connect the petitioner with the said incident and on the contrary there are statement of witnesses who have stated that the deceased had consumed poison in a fit of anger and also that the petitioner has no criminal antecedent and is in custody since 17.04.2024, the petitioner above named, is directed to be released on bail on furnishing bail-bond of Rs. 10,000/- (Rupees

No.88629 of 2024(3) dt.07-05-2025 3/3 Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Judicial Magistrate, Supaul in connection with Jadia P.S. Case No. 32 of 2024, subject to the the following conditions:- (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the Court below, if so required by the learned Trial Court.

(iii) In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be canceled by the Court concerned.
