The petitioner is apprehending arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Excise and Prohibition Act, 2016.

It is alleged that 8 litres of Indian Made Foreign Liquor has been recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that the said recovery has been made from a joint family house. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

It is submitted by learned APP for the State that anticipatory bail is not maintainable under Section 76(2) of

Patna High Court CR. MISC. No.81130 of 2019(2) dt.11-12-2019 2/2 the Bihar Prohibition and Excise Act, 2016.

Considering the nature of accusation, it is a case for consideration of prayer for regular bail by the learned Court below.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Jalalpur P.S. Case No. 175 of 2019, pending before the learned 2nd ADJcum-Special Judge, Excise, Saran at Chapra. With the above observation, this application is, accordingly, disposed of.
