JUSTICE SANDEEP KUMAR ORAL ORDER 30-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of anticipatory bail in Chapra Town P.S. Case No. 102/2019 registered for the offence punishable under Sections 379 of the Indian Penal Code. The petitioner is named in the F.I.R. and has criminal antecedent.

The supplementary affidavit filed by the learned counsel for the petitioner shows that in another F.I.R. also the petitioner was named in a case registered under Section 379 of the Indian Penal Code.

Habitual criminals like the petitioner cannot be and should not be granted anticipatory bail.

This application for grant of anticipatory bail is dismissed.

This case was registered on 04.03.2019. Since then, the petitioner has not been arrested by the police, however, no interim protection was granted to the petitioner from the Court below or from this Court.

The Superintendent of Police, Saran, will issue showcause to the Investigating Officer of the case and apprise this Court about the reasons for non-arrest of the petitioner by the police.

If the petitioner does not surrender within two weeks then the Superintendent of Police, Saran, will get the petitioner arrested and report the same to this Court within next two weeks.
