The petitioner, who is the mother-in-law of the deceased and is in custody since 13.09.2019, seeks bail in connection with Sadar P.S. Case No. 389 of 2013 dated 02.10.2013 instituted for the offence under Section 304(B) of the Indian Penal Code.

It has been submitted that nobody has seen the occurrence and the cause of the dispute between the petitioner and the deceased was that some money was sent by the husband of the deceased, out of which some amount had to be given to the deceased by the petitioner. However, since the money meant to be given to the deceased was not paid to her, she killed herself.

It appears from the records that the deceased had never in the past made any complaint about illtreatment to her. Regard being had to the nature of accusation against the petitioner and her period of custody, she is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S.
