2. The petitioner seeks regular bail in connection with Udwantnagar P.S. Case No. 472 of 2021, lodged on 31.10.2021 under Sections 20(b)(ii)(c)/22/25/27(A)/29 of the N.D.P.S. Act read with section 26 of the Arms Act.

3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 06.06.2023 passed in Cr. Misc. No. 11008 of 2023. Counsel also submits that the criminal antecedent of the petitioner is not clean and there is only one criminal case pending against him in which he is on bail. Counsel also submits that the petitioner is in custody since 31.10.2021.

4. Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.10968 of 2024(3) dt.03-05-2024 2/2 bail of the petitioner and submits that vide order dated 09.02.2024, a report about the present stage of the trial has been called for.

5. Upon perusal of the rejection order, it transpires that commercial quantity of heroine has been recovered along with live cartridges.

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Udwantnagar P.S. Case No. 472 of 2021, pending before the learned Sessions Judge, Bhojpur, Ara is hereby rejected.
