Petitioner seeks bail in Mahila P.S. Case No.22 of 2019 registered under Section 376(D) of the IPC. The victim alleged that on 31.03.2019 at about 7:20 P.M. she went to attend the call of nature by the side of canal. Vijayee Sah and Hira Panrit (petitioner) committed rape with her one by one. When the victim tried to raise alarm, both accused persons threatened her to kill. She further disclosed that her husband is living outside and her father-in-law and motherin-law had gone to Uttar Pradesh for treatment. Learned counsel for the petitioner submits that the occurrence took place on 31.03.2019 but the F.I.R. was lodged on 04.04.2019. Vijayee Sah (another co-accused) has been granted bail by a coordinate Bench of this court vide order dated 06.10.2019 passed in Cr.Misc.No.68631 of 2019. The case of the petitioner stands on the same footing. The petitioner is in jail since 20.08.2019.

Having considered the facts that on same and similar allegation the co-accused Vijayee Sah @ Brijesh Panrit has already been granted bail by a coordinate bench of this court and the case of the petitioner sands on the same footing, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M., Bagaha, West Champaran in connection with Mahila P.S. Case No.22 of 2019.
