2. The petitioners seek to quash FIR vide Mejarganj P.S. Case No. 314 of 2023 registered for the offence under Sections 406 and 409/34 of the Indian Penal Code.

3. In the FIR, it is stated that the petitioners have misappropriated Government money while discharging their

Patna High Court CR. WJC No.127 of 2024(3) dt.07-05-2024 2/2 duty as the Chairman and Manager of the PACS Basbitta.

4. Considering the nature of allegation levelled against the petitioners and also the law laid down by the Hon'ble Supreme Court in the case of Neeharika Infrastructure vs. State of Maharastra reported in SCC Online SC 315, no case for quashing the FIR is made out.
