JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 This is an application for grant of anticipatory bail in connection with Sonbarsa P.S. Case No. 163 of 2019 registered for the offences punishable under Sections 272, 273, 414 of Indian Penal Code and Sections 30(a), 38(2) and 41(1) of Bihar Prohibition and Excise Act, 2016.

As per F.I.R. there is recovery of more than 1,000 liters of illicit liquor from the Bathan of Vijay Panjiya and one scooty was also recovered from there and the name of the petitioner transpired along with other accused persons, as the persons who dealing with foreign liquor.

Submission of the learned counsel for the petitioner is that except the confidential information, there is nothing against the petitioner.

On the other hand learned A.P.P. has opposed the

Patna High Court CR. MISC. No.80294 of 2019(2) dt.10-12-2019 2/2 prayer for bail on the ground that petitioner is named in the F.I.R. and the petitioner has also been implicated in three other similar type of cases.

Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned trial court without being prejudiced by order of this Court.
