The petitioner is accused in connection with Saraiya P.S. Case No. 259 of 2019, registered under Sections 302 and 201/34 of the Indian Penal Code.

The accusation is that Manish Pandey, elder son of the informant, Makeshwar Pandey, and his wife were present at their house in the day of 27.07.2019 and wife of the informant asked to his son, Manish Pandey, to take lunch, who was talking on mobile but his son, Manish Pandey, moved from there saying that he was being called by Priyanka Kumari @ Gulabiyam (petitioner) but his son, Manish Pandey did not return. After three hours, Priyanka Kumari @ Gulabiyam (petitioner) came and informed to his wife that Manish Pandey has died and his dead body is lying beneath the tree at the

Patna High Court CR. MISC. No.79752 of 2019(2) dt.05-12-2019 2/2 bank of river, on which, his wife and others reached there then say the dead body of his son, sustaining injury at his face and nose. The informant raised suspicion that Priyanka Kumari @ Gulabiyam (petitioner) has committed the murder of his son with the help of her other associates and threw the dead body at the bank of river. Learned counsel for the petitioner submits that it would appear from the FIR that none had seen the occurrence but mere on suspicion, this petitioner has falsely been implicated in the present case. Further submission is that petitioner, who is lady, has no criminal antecedent and is in custody since 02.05.2019. Further submission is that the charge sheet has also been submitted against her.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist, West Muzaffarpur, in connection with Saraiya P.S. Case No. 259 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
