The petitioner is in custody in connection with Mirganj P.S. Case No. 102 of 2018 bearing Suppl. Special Case No. 13 of 2018 for the offence under Sections 20/22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 Learned counsel for the petitioner would submit that nothing was recovered from conscious possession of the petitioner or his house. In the instant case, co-accused Sujit Kumar @ Surja @ Suraj has been granted bail by a Coordinate Bench of this Court vide order dated 17.05.2019 passed in Cr. Misc. No. 24231 of 2019.

In order to maintain consistency, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is

No.83359 of 2019(4) dt.27-05-2020 2/2 directed to be released on bail on furnishing his personal bond to the satisfaction of the Sessions Judge-cum-Special Judge, NDPS Act, Purnea in connection with Mirganj P.S. Case No. 102 of 2018 bearing Suppl. Special Case No. 13 of 2018, due to the circumstance of total lockdown on account of the pandemic of COVID-2019, subject to the condition that the petitioner shall extend full cooperation in conclusion of the trial and in any event, he delays in concluding the trial, the court below shall be at liberty to cancel his bail bond.
