2. The present application has been filed seeking initiation of contempt proceedings against the opposite parties for their deliberate disobedience of the order dated 19.08.2025

Patna High Court MJC No.3976 of 2025(2) dt.03-07-2026 2/3 passed by this Court in C.W.J.C. No. 3115 of 2025.

3. A show-cause affidavit has been filed on behalf of opposite party nos. 2 and 3 stating, inter alia, that in compliance with the aforesaid order, the District Education Officer, Patna, vide Memo No. 13328 dated 13.12.2025, has taken a decision to extend the benefit of the 3rd MACP to the petitioners with effect from 01.01.2009. It is further stated that the said order has been ratified and affirmed by the Director, Secondary Education, Education Department, Bihar, vide Memo No. 2348 dated 15.12.2025.

4. Learned Advocate for the petitioners submitted that though the order has been passed by the Director, Secondary Education, Education Department, Bihar on 15.12.2025, the actual monetary benefits have, till date, not been paid to the petitioners.

5. Considering the submissions advanced on behalf of the respective parties and taking note of the fact that the petitioners have already been granted 3rd MACP and the order passed by the District Education Officer has been duly ratified by the Director, Secondary Education, Education Department, Bihar, this Court does not find any reason to continue with the present contempt proceeding. Accordingly, the same stands

6. However, it is expected that, if the consequential monetary benefits have not yet been paid to the petitioners, the same must be paid expeditiously in accordance with law. (Harish Kumar, J) rohit/- U
