The instance application for regular bail has been filed by the petitioner in connection with Jagdishpur P.S. Case No. 146 of 2022 instituted for the offence u/s 341, 323, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier, two times the application for bail of the petitioner was rejected by order dated 03.02.2023 passed in Cr. Misc. No. 67418 of 2022 and order dated 07.07.2023 passed in Cr. Misc. No. 25731 of 2023.

In pursuance to the direction of the Court, a Report with regard to present state of trial vide dt. 20.02.2024 has

Patna High Court CR. MISC. No.4559 of 2024(3) dt.13-03-2024 2/2 been received from which, it appears that out of total 08 witnesses not a single witness has not been examined as yet and the learned trial Court had sought two years to conclude the trial.

No fresh ground is made for reconsideration of the regular bail application of the petitioner. Accordingly, this application is rejected.

The bail application stands disposed of.

However, learned trial Court is directed to conclude the trial within six months on day to day basis, as the petitioner is languishing in judicial custody since 24.02.2023 failing which the petitioner may renew his prayer for bail application.
