2. The petitioners have preferred this application for grant of regular bail in connection with Belaganj P.S. Case No. 487 of 2024 dated 18.08.2024 registered for the offence/s punishable u/s 317(5) of the BNS and sections 25(1-B)(a), 25(8), 26 and 35 of the Arms Act.
3. As per the prosecution case, the police party conducted a raid in the house of the suspect Anuj Chaudhary in Manikpur village and six double barrel guns, two country made pistols, 12 bore cartridges, 12 gauge 70 mm cartridge rifle slug and a cash of Rs. 3,74,500/- were recovered and some of the
Patna High Court CR. MISC. No.89393 of 2024(3) dt.22-04-2025 2/3 accused fled away from the place of occurrence, however, the co-accused, Minta Devi was apprehended. Following the information of the co-accused, Minta Devi, further raids were conducted and one rifle with an empty magazine was recovered from the Scorpio and a country made pistol and 42 cartridges were recovered from the two motorcycles. It is further alleged that the petitioners were also apprehended and total 944 cartridges were recovered from the locations they disclosed.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged recovery. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 18.08.2024. The co-accused has been granted regular bail by a Bench of this Court vide order dated 18.03.2025 passed in Cr. Misc. No. 10515 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners
Patna High Court CR. MISC. No.89393 of 2024(3) dt.22-04-2025 3/3 above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya in connection with Belaganj P.S. Case No. 487 of 2024, with the condition:- (i) The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
7. The application stands allowed.
