ABHISHEK REDDY ORAL ORDER 18-11-2025 Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of admission with the consent of both the parties.

2. Having regard to the fact that the petitioners are having an alternative and efficacious remedy of filing a statutory appeal under Section 11 of the Bihar Public Land Encroachment Act, 1956 against the notices issued by the respondent No. 3 herein (Anexure-P/6 series). The present writ petition is disposed of granting liberty to the petitioners to file a statutory appeal before the Collector of the District, Nalanda (i.e., the respondent No. 2 herein) within a period of four weeks from

Patna High Court CWJC No.269 of 2025(2) dt.18-11-2025 2/2 today. On such appeal being filed, the authority shall consider the same strictly in accordance with law duly taking into consideration the documents filed by the petitioners as expeditiously as possible preferably within a period of eight weeks thereof. It is needless to mention that before passing any orders, the petitioners shall be given an opportunity of hearing. Any orders passed shall be communicated to the petitioners. If any I.A. is filed by the petitioners seeking stay of the impugned notices, the authority shall consider the same in accordance with law and pass orders immediately.

3. With the above direction, the present writ petition stands disposed of.
