JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Excise Case No. 877 of 2017 arising out of P.R. No. 54/2017, disclosing offences under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 225 liters of liquor from the Sumo Gold Car and it is alleged that petitioner and others succeeded in fleeing away.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case having no criminal antecedent and there is no source of the information to show that it is the petitioner, who succeeded in fleeing away and considering the same this court vide order dated 24.10.2019 has granted the privilege of anticipatory bail to one of the co-

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise Act, Supaul, in connection with Excise Case No. 877 of 2017 arising out of P.R. No. 54/2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
