JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2021 Perused the report of the 5th Additional Sessions Judge-cum- Special Judge, POCSO Act dated 4.11.2020. The report indicates that due to lock-down, Durga Puja and Assembly Elections the remaining witnesses have not been examined. The trial Court was of the view that the trial was likely to be concluded within two months. More than three months have passed.

In the circumstances, the present application is disposed of with direction to the court below to conclude the trial positively within a period of two months from today failing which the court below shall release the petitioner on regular bail and submit failure report to the Registrar (Vigilance) of this Court for appropriate action in the matter.
