====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 23-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Barauli P.S. Case No. 248 of 2024 dated 27.09.2024 registered for the offences punishable under Sections 8, 20(b)(ii)(C) of the N.D.P.S. Act.

3. As per the prosecution case, 28.100 kg., Ganja alongwith two weighing machine, Batkhara of 200 Grams, two knives and five Chilams were recovered from the house of the co-accused Ram Sundra Singh @ Ram Sundar Singh and 2 Kgs, Ganja was recovered from the possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.89662 of 2024(3) dt.23-04-2025 2/3 this case. It is submitted that the petitioner has no concern with the alleged offence. No incriminating article has been recovered from the possession of the petitioner. There is no statutory compliance under the provisions of B.N.S.S.,2023. It is submitted that 2.00 kgs., Ganja like substance has been recovered from the petitioner but in the F.I.R. it has not been mentioned that from which part of the body of the petitioner, the said Ganja was recovered. It is submitted that the seized contraband is less than commercial quantity. The petitioner has one criminal antecedent which is of similar nature of offence as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 28.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Gopalganj in connection with Barauli P.S. Case No. 248 of 2024 with further condition:- (I) The petitioner is directed to remain
