1. Heard the parties.

2. Petitioner seeks regular bail in connection with Piprakothi P.S. Case No. 120 of 2024 dated 09.06.2024 registered under Section 341, 323, 324, 307, 447, 379, 504, 506 / 34 of the I.P.C.

3. As per the F.I.R. on 31.05.2024 in the evening when the informant was sitting at his home, the petitioners along with other accused persons armed with sickle, hasua and knife arrived there, started abusing the informant and on protest by the informant, the petitioner Raja Kumar caught hold the informant and Kunti Devi and Suman Devi assaulted with "hasua" and sickle in the stomach of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has not committed any offence in the manner alleged. He further submits that there is land dispute between the parties. Referring to the impugned order learned counsel submits that though the learned Additional Sessions Judge-VIII, East Champaran, Motihari has discussed the injury report but has not mentioned about the nature of the injury as grievous. Similarly situated co-accused / Kunti Devi & Suman Devi have been granted anticipatory bail by this Court in Cr. Misc. No. 84455 of 2024. The petitioner is in custody since 03.09.2024 having no criminal antecedent.

Regard being had to the submissions made by the parties, taking into consideration the the fact that petitioner has got no criminal antecedent, both the parties are closely related, there is land dispute between them, similarly situated co-accused has been granted anticipatory bail by this court, the petitioner is in custody since 03.09.2024 and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail, I am inclined to grant regular bail to the petitioner.

6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of
