2. The petitioner seeks regular bail in connection with Ara Muffasil (Dhobha O.P.) P.S. Case No.315 of 2023 registered under Section 392 of the I.P.C.

3. As per prosecution case, it is alleged that three unknown persons, boarded on motorcycle, looted the bag of the informant and his colleague Amrendra Kumar while they were returning after collecting dues from customers of their bank.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to two criminal antecedents. Nothing has been recovered from possession of the petitioner and his name

Patna High Court CR. MISC. No.86365 of 2023(2) dt.23-01-2024 2/2 surfaced in this case on the basis of confessional statement of co-accused Sandip Kumar. Except confessional statement, there is nothing against the petitioner. The petitioner is a student and he is in custody since 30.08.2023.

5. Learned A.P.P. opposes the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case, submissions of the parties as well as the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. VII, Bhojpur, Ara in connection with Ara Muffasil (Dhobha O.P.) P.S. Case No.315 of 2023.
