The petitioner seeks regular bail in connection with Singheshwar P.S. Case No. 180 of 2019 for the offence registered under Sections 302, 120(B)/34 of the Indian Penal Code.

The allegation is regarding the accused persons having brutally murdered the husband of the informant. The learned counsel for the petitioner has submitted that there is no eye witness to the occurrence and merely on suspicion the petitioner has been falsely implicated in the present case. It is further submitted that as far as the petitioner is concerned, there is no specific allegation of overt act against him. It is also submitted that the petitioner is having a clean

Patna High Court CR. MISC. No.83338 of 2019(2) dt.16-12-2019 2/2 antecedent and he is languishing in custody since 30.07.2019. Lastly, it is submitted that the petitioner is ready to abide by such conditions as may be deemed fit and proper to be imposed by this Court.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura in connection with Singheshwar P.S. Case No. 180 of 2019.

It is needless to state that the petitioner would mark his presence before the Officer In-Charge of the concerned Police Station at 10:00 A.M. on each and every Monday of the month and in the event of his failure to do so on two consecutive occasion, the present privilege of bail shall stand cancelled automatically and the petitioner shall be taken into custody forthwith.
