JUSTICE ARVIND SINGH CHANDEL ORAL ORDER 23-01-2025 It is submitted by the learned counsel for the petitioner that petitioner has been appointed on the post of Lower Division Clerk on 19.08.2011 on compassionate ground. Since he has not cleared the departmental accounts examination therefore, he has not been granted benefit of 1st MACP for which he is entitled. He further submits that the claim of the petition is squarely covered with the Judgment passed by this Court in C.W.J.C. No. 18727/2017 (Kamlanand Thakur vs State of Bihar and Analogous Cases reported in 2024 (4)

Patna High Court CWJC No.213 of 2025(3) dt.23-01-2025 2/2 BLJ 806, for which he has already made a representation before the respondent vide Annexure P-3 dated 04.10.2024 but no decision has been taken by respondent/competent authority. Therefore, it is prayed by the counsel that petition may be disposed of, directing the concerned authority i.e. respondent no. 05 to consider and decide the same within the specific period fix by this Court.

2. The prayer made by the counsel does not oppose by the State counsel. However, he submits that if this Court direct the representation will be decided within eight weeks.

3. On the submission put forth by both counsels, the petition is disposed of. The respondent no. 03 is directed to consider and decide the Annexure- P/3 as early as possible probably within eight weeks from the receipt/production copy of this order in accordance with relevant rules and law and further taking into consideration the observation made by this Court in C.W.J.C. No. 18727/2017 (Kamlanand Thakur vs State of Bihar and Analogous Cases reported in 2024 (4) BLJ 806.
