The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A/34 of the IPC and Sections 3 and 4 of Dowry Prohibition Act.

The prosecution case as per the written report of Grihshobha Devi submitted to the SHO, Daraunda Police Station is to the effect that the informant was married with the petitioner on 7.5.2017. For four months, the informant was kept with all dignity and honour but thereafter, torture was inflicted upon her for non-fulfillment of further dowry demand. It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant. However,

No.73271 of 2018(5) dt.15-04-2019 2/2 a joint petition has been filed before the learned Court below on 9.4.2019 to the effect that the petitioner and the informant have decided to part ways. A certified copy of the said joint petition is being produced. Let it be kept on record.

Learned counsel for the informant submits that in view of the fact that both the sides have decided to part ways, the informant is not opposing the prayer of the petitioner for anticipatory bail.

Keeping in view the present stand of the parties, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Daraunda P.S. Case No.154 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) anil/- U
