JUSTICE RAJIV ROY ORAL ORDER 14-12-2022 Heard Mr. Dhanendra Chaubey, learned counsel for the appellant and perused the office notes dated 09.12.2022 by which the office has pointed out that the suit and the appeal value has been mentioned as Rs. 6 lakhs which is less than Rs. 10 lakhs and as such, the proper remedy seems to lie by way of filing a Memo of Regular Appeal before learned District Judge concerned in view of the enhanced pecuniary jurisdiction of the learned District Judges raised in the year of 2014. Learned counsel for the appellant submits that an I.A. No. 8917 of 2018 was also filed in the matter explaining the delay in filing the present appeal (Paragraph-3 & 4). He further submits that in view of the objection raised by the office, the matter has to be remanded back to the concerned Court of the learned District Judge.
Patna High Court FA No.161 of 2018(4) dt.14-12-2022 2/2 Accordingly ordered.
Let the office take appropriate steps for remanding the same before the concerned District Judge who shall take into account the I.A. No. 8917 of 2018 as also the period the appeal was pending before the same is being remanded back. (Rajiv Roy, J) Jagdish/Neha/- U
