2. Learned Counsel for the petitioner submits that the land where Garbage House Solid Waste Management Unit is being permitted to be constructed by the government official is his raiyati land surrounded by residential house. Counsel submits that in this matter he has filed representation before the B.D.O. and D.C.L.R. but no response has been taken from their side.

3. Learned Counsel for the petitioner submits that since construction is continuously going on, therefore,

4. Learned Counsel for the State seeks permission file counter affidavit.

5. This Court is of the firm view that if there is merit in the claim of the petitioner then after construction of the said place unnecessary money of the government shall be exhausted. As such, petitioner is directed to file representation raising all the points before the District Magistrate, Madhubani, who upon receiving the representation along with the order shall set up an inquiry and decide this matter within 60 days.
