2. Petitioner is seeking bail in connection with Jhajha P.S. Case No. 498 of 2025 registered for the offences under Section 30(a) of Bihar Prohibition and Excise Amendment Act.

3. As per FIR, 100 liters of country made liquor is said to have been recovered from the Guava orchard.

4. Learned counsel for the petitioner submits that recovery is made from Guava orchard in Guriyara Village, which is situated behind the petitioner's in-laws house. It is further submitted that petitioner has falsely been implicated in this case and the petitioner is in no way connected with this case. Petitioner has been in judicial custody since 20.10.2025. 5. Learned APP for the State vehemently opposed the prayer for bail.

6. Regard being had to the submission made by the parties and taking into consideration the fact that the recovery is made from the open place near Guava Orchard and the access of general public cannot be denied and the period of custody of the petitioner, this Court is inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Court-I, Jamui in connection with Jhajha P.S. Case No. 498 of 2025.
