Petitioner is an accused in connection with Kotwali P.S. Case No. 834 of 2019 for the offence registered under Sections 307/326/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case on mere suspicion. It is further submitted that first information report does not reveal anything against the petitioner as the petitioner is simply working as a Manager in the Hotel. In the first information report, it is apparent that the nephew of the informant himself brought the alleged bottle under the counter of the hotel. Further, the petitioner did not supply the alleged

Neither he nor his staff has supplied the bottle of drinking water. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 01.11.2019.

Having considered the above facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali P.S. Case No. 834 of 2019.
