Patna High Court CR. WJC No.154 of 2025(3) dt.08-07-2025 2/3 ORAL ORDER 08-07-2025 Heard the learned counsel for the petitioner and the learned counsel for the State.
2. The following prayer has been made in the present writ petition:- i) For issuance of writ in nature of mandamus and directing and commanding the Respondent authorities to investigate into the Khagariya Town P.S case No.524/2024 and to take appropriate actions against involved officers/persons who have made conspiracy made accused the entire family and used absurd languages etc. After that lordships may direct to penalize such persons whereby and whereunder the police have acted inhuman behavior with her and also taken licensy Gun from my house. The police have compelled to lodged counter case against the private respondents and register Khagariya(Town) P.S case No.526/2024.
ii) For further direction to the respondent authorities to submit report and quashed the FIR by police bearing Khagariya (Town) P.S case No.526/2024 and further direction to the respondents does not to disturb the peaceful life without any sufficient evidence was collected. The petitioners have innocent in this case;
) For further direction to the iii respondents to release the licency Two Nali Gun in favour of the petitioner.
3. The petitioner is given liberty to approach the Superintendent of Police, Khagaria along with a representation for redressal of his grievances.

4. If the petitioner moves before the Superintendent of Police, Khagaria by filing a representation, the Superintendent of Police will inquire into the matter himself as the allegations are against the police officials of filing false and fabricated cases against the family members of the petitioner.
5. If the representation is filed within one week, the Superintendent of Police, Khagaria will conclude the inquiry within the next two months and if the allegations levelled by the petitioner against the police officials are found true then appropriate action shall be taken by the Superintendent of Police, Khagaria.
6. During the the inquiry, the petitioner and the family members of the petitioner should also be examined by the Superintendent of Police, Khagaria.
7. With the aforesaid observation and direction, this application is disposed of.
8. Let a copy of this order be communicated to the Superintendent of Police, Khagaria through FAX for its compliance forthwith.
