The petitioner seeks bail in a case instituted for the offences under Sections 307, 379, 341, 323, 506, 147, 148, 149 of the Indian Penal Code and 25(1-b)a, 26 and 27 of the Arms Act.

The prosecution case in short is that the accused persons, variously armed, assaulted the informant at his house due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.10.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been

The petitioner is alleged to have used butt of the gun. The petitioner had no intention to commit murder of the victim. A free fight is alleged to have taken place. No arms is alleged to have recovered from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bikramganj, Rohtas in connection with Karakat P.S. Case No. 173/2019.
