The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

According to FIR, three accused persons including the petitioner assaulted with iron rod and lathi causing injury at the head of the father of the informant, who died during the course of treatment.

The post mortem report would reveal single injury on the head of the deceased. The petitioner is in custody since 23.07.2018. Investigation of the case is complete now. Considering the fact that it is difficult to attribute as to

No. 76923 of 2018(4) dt.11-04-2019 2/2 who of the three caused the single injury, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ayar P.S. Case No.48 of 2018, with condition that petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
