====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 23-04-2025 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 325, 307, 379, 504 of the Indian Penal Code.

3. The FIR has been lodged against as many as eight persons of the same family with an allegation that they have all indulged in assault upon the informant and his family members. So far as the present petitioner is concerned, there is a specific allegation upon him that he inflicted farsa blow upon the informant due to which his head and nose got injured.

4. Learned counsel for the petitioner submits that the

Although there is a specific allegation against the petitioner that he inflicted farsa blow on the informant due to which his head and nose got injured, the bare perusal of the injury report of the informant would goes to show that no doubt, there are injuries on his person and the said injuries were even reserved for the final opinion, but the final opinion on the injuries would indicate that the same were simple in nature caused by hard and blunt object. It is further submitted that some of the co-accused persons including one Shiv Nandan Rai have been granted the privilege of anticipatory bail by this Court vide order dated 24.04.2024 passed in Cr. Misc. No. 18171 of 2024.

5. Learned APP for the State opposes the prayer for anticipatory bail.

Considering all the above mentioned facts and circumstances of the case and also that petitioner has no criminal antecedent, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Saran at

Patna High Court CR. MISC. No.1962 of 2025(4) dt.23-04-2025 3/3 Chapra in connection with Garkha P.S. Case No. 271 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023.
