The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The prosecution case as per the written report of Raghu Yadav submitted to the Station House Officer of Bandhva Khurba Police Station is to the effect that the daughter of the informant, namely, Tulsi Devi was married with Nawal Kishore Yadav about 16 years prior to the alleged occurrence and they were blessed three children, but two years prior to the occurrence, the husband of the informant's daughter developed

Patna High Court CR. MISC. No.81123 of 2019(2) dt.11-12-2019 2/3 intimacy with the petitioner, which was protested by the daughter of the informant and in that protest, on 13.08.2018 the husband of the daughter of the informant assaulted the daughter of the informant and on 14.08.2018 the dead body of the daughter of the informant was found in a well. It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the petitioner has been roped in the present case, thrust of accusation is against the husband of the victim and petitioner is a lady. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that it is suspected that the petitioner in league with the husband of the victim killed the victim.

Considering the thrust of accusation against the husband of the victim and petitioner being a lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka in connection with Bandhva Khurba P.S.
