2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 201 , 341 , 323 , 504, 506 and 34 of the Indian Penal Code .

As per the prosecution case , informant Seema Devi alleged that on 09.11.2022 , she received information that due to land dispute , this petitioner along other co-accused persons killed husband of informant. It is further alleged that when informant along with her family went to her sasural Panchadecta in the morning , in the meantime , all the accused persons abused and assaulted her, any how , informant saved herself and reached to ANMMCH Gaya in injured condition to take medical treatment.

4. Learned counsel for the petitioner submits that the petitioner is the deceased's own brother. The informant is not an eyewitness to the alleged occurrence. The alleged occurrence took place on 09.11.2022 but ferdbeyan was given on 13.11.2024 , after delay of 4 days and F.I.R. has been lodged after a delay of 15 days of the occurrence for which there is no plausible explanation. As a matter of fact, before the occurrence, the deceased went to his in-laws house to bring his wife, but she refused to come, due to which there was a quarrel between husband and wife in which the deceased was brutally assaulted by his in-laws, and thereafter the deceased returned and locked himself in a room and committed suicide.
Thereafter, family members of the deceased broke the door in the presence of several villagers, and the same was informed to the wife, but she didn't come, and the dead body of the deceased was cremated, and after a lapse of 4 days of occurrence , the wife of the deceased lodged the present case . During course of investigation, several independent witnesses have stated that deceased committed suicide in a locked room and his dead body was recovered after breaking the door. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI Gaya in connection with Tekari P.S. case No. 126 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
