Smt. Binita Singh- Sc28 ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 21-11-2022 Heard the parties.
The petitioners by way of this petition prays for quashing of an order dated 07.01.2012 passed by the District Teachers Appointment Appellate Authority, Nawadah and also challenges the order dated 28.09.2015 passed by District Teachers Appointment Appellate Authority, Nawada whereby the appeal preferred by the petitioners was rejected. This Court notices that after the order passed by the District Teachers Appointment Appellate Authority dated 28.09.2015, the petitioners did not avail the remedy of filing an appeal before the State Appellate Authority, which became functional in 2017. The writ petition has been filed in 2018, although in normal course, the petitioner may not have been granted any liberty but considering the fact that the State Appellate Authority became functional only in 2017, I am inclined to grant liberty to the petitioners to file an appeal before
7/7 the State Appellate Authority against the order passed by the District Appellate Authority.
The writ petition is disposed of with the aforesaid liberty.
