The petitioner seeks regular bail in connection with G.B. Nagar P.S. Case No. 07 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. The allegation is regarding unknown persons having intercepted the informant and waylaid him and looted a sum of Rs. 66,000/- .
The learned counsel for the petitioner submits that the petitioner is not named in the FIR and no incriminating article has been recovered from the possession of the petitioner as well as no T.I. Parade has been held till date, however, the Police has already submitted charge sheet. It is further submitted that the petitioner is accused in two other cases, however, he is on bail
Patna High Court Cr.Misc. No.77085 of 2018(2) dt.18-01-2019 2/2 in the said two cases. The petitioner is stated to be languishing in custody since 130.06.2018. Lastly, it is submitted that similarly situated co-accused has already been granted bail by this Court by an order dated 26.09.2018 passed in Criminal Misc. No. 51336 of 2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st-cumSpecial Judge, Siwan in connection with G.B. Nagar P.S. Case No. 07 of 2018.
