The petitioner apprehends his arrest in connection with Mojahidpur (Babarganj) P.S. Case No. 262 of 2019, registered under Sections 147, 149, 341, 323, 307, 448, 504 and 506 of the Indian Penal Code.

The accusation is that five to six persons were consuming wine and Ganja near the well adjacent to the house of the informant, Ankit Kumar Gupta. At that time, some persons knocked the door and made demand of water from him. On refusal, they started to assault him through iron road causing injury at his head. At that time, his brother was not present at his house when his brother came then he came at the

Patna High Court CR. MISC. No.81377 of 2019(3) dt.17-06-2020 2/2 Police Station and informed about the incident. At that time, he identified two persons, namely, Suraj Kumar Sinha (petitioner) and Chhotu Mandal out of five miscreants.

Learned counsel for the petitioner submits that while the allegation has been made about causing injury through iron road by five to six persons including the petitioner but only two injuries were found on the person of the informant, which is simple in nature as detailed in the injury report dated 11.09.2019 attached with the carbon copy of the case diary. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Mojahidpur (Babarganj) P.S. Case No. 262 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
