JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 29-01-2024 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 304(B), 315 of the Indian Penal Code. The informant alleged that all her in-laws family members including the petitioners poured kerosene oil on her body and lit fire, as a result of which, she sustained burning injuries and subsequently died during the course of treatment.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.1890 of 2024(2) dt.29-01-2024 2/2 petitioners that petitioners are innocent and they have falsely been implicated in this case. The petitioners are brother-in-law and married sister of the husband of the deceased and they had no concern with the day-do-day affairs of the deceased and her husband. The petitioners live separately from the husband of the deceased. The petitioners are languishing in custody since 17.09.2023. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, West, Muzaffarpur in connection with Saraiya P.S.
