1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has renewed his prayer for grant of regular bail in connection with NDPS Case no. 8 of 2022 arising out of Kasim Bazar P.S. Case no. 220 of 2022 registered under sections 8, 20 (b)(ii)(c), 25 and 29 of the N.D.P.S. Act.

3. As per the prosecution case, on the vehicle being intercepted and checked, it is stated that 206 Kgs of ganja was recovered and the accused persons were taken into custody. It is further stated that on inquiry, they disclosed that the seized ganja belonged to the petitioner herein.

4. Learned counsel for the petitioner submits that the earlier prayer for bail of the petitioner was rejected vide order dated 23.8.2024 (Annexure-P/1) passed in Cr. Misc. no. 15938

Patna High Court CR. MISC. No.90239 of 2024(2) dt.17-01-2025 2/2 of 2024. The petitioner is in custody since 28.8.2023 and charge has been framed in the learned trial Court on 5.12.2024. A copy of the order framing charge has been brought on record as Annexure-P/6 to this petition. The petitioner undertakes to cooperate in the trial.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, the petitioner having remained in custody for more than 1 year 4 months since 28.8.2023, his not having any criminal antecedent, the liberty granted in the earlier order rejection dated 23.8.2024 and charge having been framed in the learned trial Court on 5.12.2024, the petitioner is directed to be enlarged on bail in connection with NDPS Case no. 8 of 2022 arising out of Kasim Bazar P.S. Case no. 220 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, Munger.
