JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2019 Petitioner seeks regular bail in connection with Special Case No. 9291 of 2019 arising out of Khusrupur P. S. Case No. 333 of 2019 registered for the offence punishable under Section 37 (C) of the Bihar Prohibition & Excise Amendment Act.

As per F.I.R. petitioner was arrested in a drunken condition and it further appears that petitioner is accused in seven other cases also, one of them is also of under Section 37 of the Bihar Prohibition and Excise Act, 2016. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. Now he is remained in custody for about two months. He is ready to abide by any condition imposed on him.

No.83721 of 2019(2) dt.17-12-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge Excise Act, Patna, in connection with Special Case No. 9291 of 2019 arising out of Khusrupur P. S. Case No. 333 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to appear before the local police station of his area for a period of nine months, so that, he may watch the conduct of the petitioner, otherwise his bail bonds shall be cancelled.

Let a copy of this order be communicated to the S.S.P. Patna, for needful.
