JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2020 Earlier the prayer for bail of the petitioner was rejected twice by the then Co-ordinate Bench of this Court, firstly vide order dated 18.8.2018 passed in Cr. Misc. No.48620 of 2018 and secondly vide order dated 27.3.2019 passed in Cr. Misc. No.15969 of 2019.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. Wife of the informant was killed by informant himself and implicated the present petitioner.

Heard learned APP and perused the record, from which it appears that the petitioner was arrested while fleeing away after causing injury to the wife of the informant as well as the informant, he was seen fleeing by the witnesses and from the report received from the learned trial court it appears that out of

Patna High Court CR. MISC. No.79294 of 2019(3) dt.19-02-2020 2/2 five witnesses two non-official witnesses have already been examined and the trial is going on.

Having heard both sides and considering the allegation, I am not inclined to grant bail to the petitioner. As the petitioner is in custody since 26.5.2018, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months and if the trial is not concluded, the petitioner is at liberty to renew his prayer for bail.
