2. The petitioners seek bail in connection with Rajoun (Nawada Bazar O.P.) P.S. Case No. 398 of 2024 registered for the offence under Sections 21(c)/22(c)/25 of the NDPS Act.

3. As per the prosecution case, the recovery is of 12000 bottles of codeine rich cough syrup from the petitioners.

4. It has been submitted by the learned counsel for the petitioners that the petitioners are the driver and helper of the bolero pick-up in which the codeine rich cough syrup was being transported. It has further been submitted by the learned

Patna High Court CR. MISC. No.89664 of 2024(3) dt.22-03-2025 2/2 counsel for the petitioner that codeine was being sent under legally to the medical agency.

5. The petitioners are in custody since 22.08.2024.

6. Considering the fact that the petitioners are driver and helper of the bolero pick-up and they have no knowledge of what was being transported in the bolero pick-up, this application is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge (NDPS Act), Banka/concerned Court below in connection with Rajoun (Nawada Bazar O.P.) P.S. Case No. 398 of 2024.

8. It is made clear that this order shall not be cited as a precedent in any other case.
