2. The petitioner seeks regular bail in connection with Bairiya P.S. Case No.162 of 2024 lodged under Sections 306, 201/34 of the I.P.C.
3. As per the prosecution case, the F.I.R. has been lodged against five named accused persons including the petitioner (all are family members) against whom there is allegation that the marriage of the daughter of the informant took place with the petitioner and due to abusive attitude, his wife suicide herself and his family member had evade the dead body of the daughter of the informant.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits

No.89116 of 2024(2) dt.18-01-2025 2/3 that death of the wife of the petitioner has caused due to illness and he has not apprise in this matter to anyone and her last rite was performed in presence of in-laws family members which they have accepted by way of filing an affidavit before the A.C.J.M. where the trial of the petitioner is pending.
5. Learned Counsel further submits that this case has been lodged due to wrong information communicated to the unknown enemy of the petitioner and his family which is subsequently, accepted in the different affidavit which is annexure-2 series.
6. Learned Counsel further submits that the petitioner is in custody since 02.08.2024 having clean antecedent and charge-sheet has already been submitted in this case.
7. Counsel also submits that the other co-accused has been granted bail by this Court vide order dated 11.09.2024 passed in Cr. Misc. No. 61715/2024.
8. Learned counsel for the State opposes the prayer for bail and submits that from the record, it transpires that the petitioner has no criminal antecedent and different affidavits have been filed by the different family members including the mother, father and brother of the deceased.
9. In the present facts and circumstances of this case
Patna High Court CR. MISC. No.89116 of 2024(2) dt.18-01-2025 3/3 and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-III, West Champaran at Bettiah in connection with Bairiya P.S. Case No.162 of 2024, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
