====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 23-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Madanpur P.S. Case No. 218 of 2017, instituted for the offence under Section(s) 394 and 120(B) of the Indian Penal Code.

Counsel for the petitioner submits that name of petitioner has been taken by co-accused Ajit Mali who was arrested by the police with Tractor. There is no recovery of any incriminating article from possession of the petitioner. Counsel for the petitioner further submits that co-accused Sanjay Yadav with similar allegation has been granted bail by coordinate Bench of this Court vide order dated 8.2.2018 passed in Cr. Misc. 61871 of 2017.

Petitioner is in custody since 30.6.2018 having clean

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S.
