The petitioner apprehends his arrest in connection with Complaint Case No. 897 © of 2016, registered under Sections 341, 323, 379, 504, 307 and 498(A)/34 of the Indian Penal Code.

The accusation is that the marriage of the complainant/O.P. No.2 was performed with this petitioner on 22.02.2016 and after marriage, she went to her matrimonial house with gifted articles, ornament and clothes, but after one day she was being tortured for demand of one motorcycle. Then complainant/O.P. No.2 informed the matter to her father, who came in her matrimonial house and took her in Bidai on 22.03.2016 on assurance of husband (petitioner) to keep

No.78557 of 2018(4) dt.01-05-2019 2/2 properly, but she was again tortured and ultimately on 20.05.2016, she was dashed in the well by the accused persons, but on hulla, she was saved by the neighbours and after one day she was removed from her matrimonial house after snatching her personal belongings. It is further alleged that the husband of the petitioner has illicit relation with Babita Devi. Learned counsel for the petitioner submits that, admittedly, the petitioner is the husband of the informant and petitioner is ready to keep his wife (complainant/O.P. No.2) with full dignity, but she does not want to live at the house of petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Danapur, Patna in connection with Complaint Case No. 897 © of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
