2. The petitioner has prayed for bail in connection with Garbandanga P.S. Case No. 38 of 2025 registered for the offence punishable under Sections 319(2), 318(4), 336(2), 338 and 336(3) of the B.N.S. and Section 66(C)/(D) of the I.T. Act.

3. The case of the prosecution is that the Revenue Officer was directed to verify four residential certificates. The said four residential certificates were found not issued by RTPS and were suspicious. Thereafter, the informant observed that the residential certificates have been issued by utilizing his forged digital signature. Three persons in whose favour the said certificates were issued disclosed that they got prepared the certificates from the computer shop of the co-accused Ajay

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R. it is clear that the name of this petitioner is not there rather there is name of co-accused Ajay Kumar Sah. From perusal of the learned trial Court's order, it is clear that the name of this petitioner has come during course of investigation on the statement of co-accused Ajay Kumar Sah. Ajay Kumar Sah has disclosed that he was making forged certificates by utilizing computer link, dashboard, birth.com. SDR of the mobile number given in the link was procured and it was found that the petitioner was holder of the mobile number.

The petitioner has also given his confessional statement and has stated that he was involved in the alleged occurrence. It has also been submitted that save and except the confessional statement and mobile number, there is nothing against him and there is no allegation against him that he has prepared any forged certificate. The main thrust of allegation is against coaccused Ajay Kumar Sah. It has also been submitted that petitioner is resident of different State.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Kishanganj in connection with Garbandanga P.S. Case No. 38 of 2025.
