Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Mirganj P.S. Case No. 95 of 2019, registered under Sections 409, 420, 467, 468 and 741 of the Indian Penal Code, pending in the court of learned Judicial Magistrate Ist Class, Purnea.
The accusation is that work for construction of PCC road was allotted in tender to the petitioner, which was to be
Patna High Court CR. MISC. No.81790 of 2019(7) dt.08-02-2021 2/2 constructed 10 feet width and 8 inch depth, respectively, but on measurement in several places, the width of PCC road was found 8 feet and depth of PCC road was found 5 inch. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
