JUSTICE MADHURESH PRASAD ORAL ORDER 27-06-2019 The petitioner has made his claim before the Establishment Deputy Collector, East Champaran, Motihari, for grant of benefits under the assured career progression scheme. The detailed claim of the petitioner is at Annexure 7 of the writ petition. The same has been submitted to the District Magistrate, East Champaran, Motihari.

Petitioner's Counsel submits that till date issue has not been decided by respondent No. 5 and that such claim of the petitioner is unnecessarily held up due to inaction on the part of the respondents.

In view of the submissions, it is apparent that the decision has to be taken by the respondent No. 5. Pendency of

Patna High Court CWJC No.39 of 2019(2) dt.27-06-2019 2/2 the instant proceeding, therefore, would be futile. Let respondent No. 5 take a final decision on the claim made by the petitioner (Annexure 7) by a reasoned and speaking order in accordance with law. If dues are found admissible to the petitioner the same should be paid to him within a period of three months from the date of receipt/ production of a copy of this order.

The writ petition stands disposed of.
