JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2019 The petitioner, who is custody since 17.11.2019, seeks bail in connection with Banka P.S. Case No. 703 of 2019, dated 02.10.2019, instituted for the offences under Sections 30(a) (d) and 32 of Bihar Prohibition and Excise (Amendment) Act, 2018.

Six and half quintals of Mahua flower was found to be loaded on a trailor of a tractor. Two motorcycles were also found at the place where Mahua flower was being loaded. Some persons were also seen fleeing away from the

Patna High Court CR. MISC. No.82413 of 2019(2) dt.12-12-2019 2/2 place of occurrence. Though the petitioner has not been named in the F.I.R., but since he owns one of the motorcycles which was seized from the place of occurrence, he has been implicated in this case.

Considering the aforestated facts, viz., that there is no recovery from the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II, Banka in connection with Banka P.S. Case No. 703 of 2019.

The application stands allowed.
