2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 140 (3), 137

(2) and 351 (3) (5) of the BNS and Section 8/12 of the POCSO Act.

3. The case of the prosecution is that altogether 11 persons had kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that during the course of investigation, the victim has given her

Patna High Court CR. MISC. No.88614 of 2025(3) dt.11-02-2026 2/2 statement under Sections 180 and 183 of the BNS wherein she has not named this petitioner. The name of the petitioner finds mention only in the FIR. There is a general and omnibus allegation against this petitioner whereas the main thrust of allegation is against Abhishek Kumar. Moreover, the petitioner is languishing in judicial custody since 09.10.2025. 5.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Harsidhi P.S. Case No. 667 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th District and Additional Sessions Judge cum Exclusive Special Judge, POCSO Act, East Champaran.
