2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 302 and 201 of the Indian Penal Code.

3. The case of the prosecution is that the informant received an information that one unidentified body is lying near village-Doguna. The informant accordingly informed the S.H.O. and went to the place of occurrence and found that one unidentified body was lying there which was beheaded and it was not being identified. During investigation the father of the deceased has identified the dead body.

4. Learned counsel for the petitioner has submitted that initially the case was filed against unknown miscreants. During course of investigation this petitioner has given his

There is nothing excpet confessional statement of the petitioner himself. There is nothing against him. Learned counsel furhter submits that co-accused Mukesh Paswan has been granted bail by this Court vide Cr. Misc. Case No. 76929 of 2024. The case of this petitioner stands on similar footing. The petitioner is in custody since 16.04.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail. He submits that the petitioner is having criminal antecedent of three cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sessions Trial No. 720 of 2024 arising out of Gaya Chandauti P.S. Case No. 57 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of Additional District and Sessions Judge- Vth, Gaya.
